In Tennessee, there are two types of divorces: uncontested and contested. In an uncontested divorce, you and your spouse must agree on all aspects of the divorce – including a parenting plan if minor children are involved – and not require the assistance of the court. In a contested divorce, you must provide proof of grounds – for example, inappropriate marital conduct, habitual drug use or drunkenness, conviction of a felony, or failure to provide for a spouse although able to do so. In contested divorces, the court will resolve disagreements about the terms of separation, including child custody, child support, division of assets, spousal support, etc.

If you are 18 years or older and of sound mind, you can make your own will in Tennessee. However, consulting an attorney will help you ensure that your will is properly witnessed, signed and efficiently executed; your property is distributed according to your wishes; and your minor children end up in the right hands. Consulting a attorney also reduces the risk of legal challenges and family disputes.
Remember also, if you die without a will, your estate will be distributed according to state laws, which may not align with your wishes.
